What it is and why it's mandatory
The PEP and Sanctions service helps you comply with Portuguese Law No. 83/2017, which requires businesses in several sectors — namely real estate, insurance, legal services and online gambling, among others — to carry out due diligence on their customers to prevent terrorist financing and money laundering. Under Articles 18(2)(e) and 39 of that law, you must check whether your customer qualifies as a Politically Exposed Person (PEP). Additionally, under international law and Article 18(2)(g) of the same law, you must also check whether your customer appears on the European Union and United Nations sanctions lists. Lusopay provides obligated businesses with payment services that include the same screening tool Lusopay uses to screen its own customers, allowing you to meet this legal obligation at an affordable price.
Penalties provided for by law
Non-compliance is punishable under Article 170 of Law No. 83/2017:
- A fine of €5,000 to €1,000,000 if the offender is a legal person or an equivalent entity.
- A fine of €2,500 to €1,000,000 if the offender is a natural person.
In addition, the following accessory sanctions apply under Article 171:
- Forfeiture, in favour of the State, of the object of the offence and the economic benefit obtained by the offender.
- Closure, for up to two years, of the establishment where the offender carries out the profession or activity.
- Prohibition, for up to three years, from carrying out the profession or activity concerned.
- Prohibition, for up to three years, from holding management, direction, supervisory-board, representation, mandate and oversight functions in entities subject to supervision by the competent sectoral authority and in entities under common control or grouped with them.
- Publication of the final or non-appealable decision.

Limits
- Lusopay reserves the right to cancel the PEP and Sanctions service for customers who do not use the payment services marketed by our company.
- We do not impose limits on the number of queries per month or year that each customer can make. However, we reserve the right to cancel the service if it is not used responsibly.
- Resale of this service is prohibited.
- Except with prior written authorisation, the use of bots or other automated systems to query our PEP and Sanctions lists is not permitted.
